Cancellation of instruments


The civil court has the jurisdiction to cancel any written instrument upon the request of  a person against whom such document is void or voidable and if such document is not cancelled then such person may suffer may lost. In such situation the Court shall order the document should be produced before the Court and the Court shall adjudge the same as cancelled. 
If the document is registered before the Registrar under Registration of Documents Act, then the Court shall send the attested the copy of the order to the Registrar with the direction to writ on the document about the cancellation of the same through court. All this is done under the Section 39 of the Specific Relief Act.
