Habeas Corpus is a direction from the court whereby the person is brought before the court. In Pakistan both the District and Sessions Court and the High Court has the power to issue directions of habeas corpus. The procedure to issue habeas corpus is of two types.
Firstly the court appoint the bailiff of the court on the request of the applicant and secondly the court directs the police to produce the person before the court. District & Sessions Court has the jurisdictions to issue habeas corpus under Code of Criminal Procdure whereas the High Court has the Power to issue directions under the Constitution of Pakistan.
